Pokud je pojištění nabízeno v rámci práva usazování nebo volného pohybu služeb, musí být pojistník před uzavřením jakéhokoli závazku uvědoměn o tom, ve kterém členském státě se nachází sídlo, případně pobočka, se kterou má být smlouva uzavřena.

If the undertaking which has committed the offence has an establishment or possesses property in the Member State of provision of services, the supervisory authorities of the latter may, in accordance with national legislation, apply the administrative penalties prescribed for that offence by way of enforcement against that establishment or property.
Má-li pojišťovna, která se dopustí protiprávního jednání, v členském státě, ve kterém jsou poskytovány služby, svou provozovnu nebo tam vlastní majetek, mohou orgány dozoru tohoto státu v souladu s vnitrostátními právními předpisy proti této provozovně nebo majetku uplatnit správní sankce stanovené pro takové protiprávní jednání.

Member States shall ensure that investment services and the other services listed in Section C of the Annex may be provided within their territories in accordance with Articles 17, 18 and 19 either by the establishment of a branch or under the freedom to provide services by any investment firm authorized and supervised by the competent authorities of another Member State in accordance with this Directive, provided that such services are covered by the authorization.
Členské státy zajistí, aby investiční a ostatní služby uvedené v oddíle C přílohy mohly být poskytovány na jejich území v souladu s články 17, 18 a 19, a to buď zřízením pobočky, nebo v souladu s volným pohybem služeb jakýmkoli investičním podnikem, který má povolení příslušných orgánů jiného členského státu a je pod jejich dohledem v souladu s touto směrnicí, pokud tyto služby spadají do oblasti, na kterou bylo povolení vydáno.

Any undertaking which intends to provide services shall first inform the competent authorities of the head office Member State, and, where appropriate, of the Member State of the establishment concerned, indicating the Member State or Member States within the territory of which it contemplates providing services and the nature of the risks which it proposes to cover.
Každá pojišťovna, která hodlá poskytovat služby, nejprvě informuje příslušné orgány členského státu sídla a případně i členského státu provozovny, přičemž uvede členský stát nebo členské státy, na jejichž území zamýšlí poskytovat služby, a povahu rizik, která hodlá krýt.

Under the conditions laid down by national law, each Member State shall authorize insurance undertakings with head offices within its territory to transfer all or part of their portfolios of contracts, concluded either under the right of establishment or the freedom to provide services, to an accepting office established within the Community, if the competent authorities of the home Member State of the accepting office certify that after taking the transfer into account the latter possesses the necessary solvency margin.
Každý členský stát povolí za podmínek stanovených vnitrostátními právními předpisy pojišťovnám se sídlem na jeho území převod celého nebo části kmene pojistných smluv, které byly uzavřeny v rámci práva usazování nebo volného pohybu služeb, na přijímající subjekt usazeného ve Společenství, jestliže příslušné orgány domovského členského státu přijímajícího subjektu potvrdí, že tento subjekt bude mít po uskutečnění převodu nezbytnou míru solventnosti.

Any undertaking carrying on business under the right of establishment or the freedom to provide services shall submit to the competent authorities of the Member State of the branch and/or of the Member State of the provision of services all documents requested of it for the purposes of this Article in so far as undertakings with head offices in those Member States are also obliged to do so.
Každá pojišťovna, která vykonává svou činnost v rámci práva usazování nebo volného pohybu služeb, musí předložit příslušným orgánům členského státu pobočky nebo členského státu, ve kterém jsou poskytovány služby, veškeré doklady od ní vyžadované pro účely tohoto článku, pokud tak jsou povinny učinit také pojišťovny, které mají sídlo v těchto členských státech.
