This Directive constitutes the essential instrument for the achievement of the internal market, a course determined by the Single European Act and set out in timetable form in the Commission's White Paper, from the point of view of both the freedom of establishment and the freedom to provide financial services, in the field of credit institutions.
Tato směrnice je z hlediska svobody usazování i z hlediska volného pohybu služeb v bankovnictví základním nástrojem pro dosažení společného trhu, jak bylo rozhodnuto Jednotným evropským aktem a naplánováno v Bílé knize Komise.

This Directive approximates, to the extent necessary for the achievement of the objective set out in paragraph 1, certain national provisions on information society services relating to the internal market, the establishment of service providers, commercial communications, electronic contracts, the liability of intermediaries, codes of conduct, out-of-court dispute settlements, court actions and cooperation between Member States.
Je-li to pro dosažení cíle uvedeného v odstavci 1 potřebné, dbá tato směrnice o sblížení některých vnitrostátních ustanovení platných pro služby informační společnosti, která se týkají vnitřního trhu, usazování poskytovatelů služeb, obchodních sdělení, elektronických smluv, odpovědnosti zprostředkovatelů, kodexů chování, mimosoudního urovnávání sporů, soudních postupů a spolupráce mezi členskými státy.

The optical path length shall be submitted by the instrument manufacturer taking into account any measures against sooting (e.g. purge air).

The host Member State may, in connection with the exercise of the right of establishment and the freedom to provide services, require compliance with specific provisions of its own national laws or regulations on the part of institutions not authorised as credit institutions in their home Member States and with regard to activities not listed in Annex I provided that, on the one hand, such provisions are compatible with Community law and are intended to protect the general good and that, on the other hand, such institutions or such activities are not subject to equivalent rules under this legislation or regulations of their home Member States.
U podniků, které nebyly ve svém domovském členském státě povoleny jako úvěrové instituce, a u činností neuvedených v seznamu může hostitelský členský stát v souvislosti s výkonem práva usazování a volného pohybu služeb vyžadovat dodržení zvláštních ustanovení svých vnitrostátních právních předpisů, jsou-li tyto předpisy slučitelné s právem Společenství a odůvodněny obecným zájmem a nepodléhají-li tyto úvěrové instituce nebo činnosti srovnatelným pravidlům obsaženým v právních předpisech svých domovských členských států.

Pursuant to the Treaty, any discriminatory treatment with regard to establishment and to the provision of services, based either on nationality or on the fact that an undertaking is not established in the Member State where the services are provided, is prohibited.
