Whereas use of these procedures which are set out in Council Decision 87/373/EEC of 13 July 1987 laying down the procedures for the exercise of implementing powers conferred on the Commission (5) would make it possible to improve the efficiency of the Community's decision making in order to facilitate the effective exercise of the right of establishment of, and freedom to provide services by, those medical specialists whose rights are dependent on the updating of the said provisions;

Whereas the Community endeavours to achieve to the greatest extent possible the objective of free movement of capital between Member States and third countries, including the removal of any restrictions on direct investment - including investment in real estate - establishment, the provision of financial services or the admission of securities to capital markets;

whereas such branches will not enjoy the freedom to provide services under the second paragraph of Article 59 of the Treaty, or the right of establishment in Member States other than those in which they are established;

Whereas freedom of establishment and the free movement of goods must not be jeopardized either by the authorization to maintain national laws or by any regulations on labelling to distinguish these products from similar foodstuffs;
vzhledem k tomu, že svoboda usazování a volný pohyb zboží nesmějí být ohroženy povolením zachovat vnitrostátní právní předpisy ani případnými nařízeními týkajícími se označování, které povolují odlišení těchto výrobků od podobných potravin;

Whereas Council Directive 74/561/EEC of 12 November 1974 on admission to the occupation of road haulage operator in national and international transport operations (4), Council Directive 74/562/EEC of 12 November 1974 on admission to the occupation of road passenger transport operator in national and international transport operations (5) and Council Directive 77/796/EEC of 12 December 1977 aiming at the mutual recognition of diplomas, certificates and other evidence of formal qualifications for goods haulage operators and road passenger transport operators, including measures intended to encourage these operators effectively to exercise their right to freedom of establishment (6) have been substantially amended on a number of occasions;
vzhledem k tomu, že směrnice Rady 74/561/EHS ze dne 12. listopadu 1974 o přístupu k povolání provozovatele silniční přepravy zboží v oblasti vnitrostátní a mezinárodní dopravy4, směrnice Rady 74/562/EHS ze dne 12. listopadu 1974 o přístupu k povolání provozovatele silniční přepravy osob v oblasti vnitrostátní a mezinárodní dopravy5 a směrnice Rady 77/796/EHS ze dne 12. prosince 1977 o vzájemném uznávání diplomů, osvědčení a jiných dokladů o dosažené kvalifikaci provozovatelů silniční přepravy zboží a osob, a obsahující opatření na podporu účinného výkonu svobody usazování těchto dopravců6 byly několikrát podstatným způsobem změněny;

Whereas certain obligations, provided for by the Partnership and Cooperation Agreement outside the scope of Community trade policy, affect or are likely to affect the arrangements laid down by Community acts adopted in the areas of the right of establishment, transport and the treatment of enterprises;

Member States shall, in respect of the activities referred to in this Directive, take the measures defined in this Directive concerning the establishment in their territories of the natural persons and undertakings referred to in Title I of the general programme for the abolition of restrictions on freedom of establishment (7).
Členské státy přijmou opatření vymezená v této směrnici týkající se usazování fyzických osob a společností uvedených v hlavě I obecného programu pro odstranění omezení svobody usazování7 na jejich území.
